1. Our Commitment to Copyright
Quoth GM respects intellectual property rights. If you believe someone has uploaded content that infringes your copyright, this page tells you exactly how to notify us and what we will do about it.
Quoth GM respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, Quoth GM will respond promptly to valid claims of copyright infringement and will take appropriate action, including removing or disabling access to allegedly infringing content.
Quoth GM has registered a Designated Agent with the United States Copyright Office to receive notices of claimed copyright infringement.
2. Designated DMCA Agent
This is the official address where copyright owners must send takedown notices. Using any other contact method does not start the formal DMCA process.
Copyright infringement notices must be sent to our designated agent. Notices sent to any other address do not constitute valid DMCA notice.
Designated Agent: NovaEventus ECM, LLC / Quoth GM, Attn: DMCA Agent, PO Box 29, Loon Lake, WA 99148. Email: dmca@quothgm.com.
[PLACEHOLDER: Insert US Copyright Office Registration Number and confirmation date once registration is complete.]
3. How to Submit a Copyright Takedown Notice
To ask us to remove content you believe infringes your copyright, send a written notice that includes all of the items listed below. Submitting a false notice can expose you to legal liability.
To submit a valid DMCA takedown notice, your written communication must include all of the following elements as required by 17 U.S.C. § 512(c)(3):
(a) A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right allegedly infringed.
(b) Identification of the copyrighted work claimed to be infringed.
(c) Identification of the material claimed to be infringing and information reasonably sufficient to permit Quoth GM to locate it (for example, the URL or specific location within the application).
(d) Your contact information — address, telephone number, and email address.
(e) A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
(f) A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.
Send completed notices to: dmca@quothgm.com. Warning: Under 17 U.S.C. § 512(f), knowingly misrepresenting that material is infringing may result in liability for damages including attorneys' fees.
4. How to Submit a Counter-Notice
If your content was removed and you believe it was a mistake, you can send a counter-notice. If it meets legal requirements, we will restore your content within 10 to 14 business days unless the copyright owner files a lawsuit.
If you believe content you submitted was removed as a result of a mistake or misidentification, you may submit a written counter-notice to dmca@quothgm.com.
A valid counter-notice must include: (a) your physical or electronic signature; (b) identification of the material removed and where it appeared; (c) a statement under penalty of perjury that you believe the material was removed by mistake; and (d) your name, address, telephone number, and consent to jurisdiction of the Federal District Court for your address.
Upon receipt of a valid counter-notice, Quoth GM will forward a copy to the original complainant and restore the removed content within ten (10) to fourteen (14) business days, unless notified that the complainant has filed a court action.
5. Repeat Infringer Policy
Users who repeatedly infringe copyright will have their accounts permanently terminated. This policy is required by federal law.
In accordance with 17 U.S.C. § 512(i)(1)(A), Quoth GM maintains a policy of terminating the accounts of users who are repeat infringers of third-party intellectual property rights. A user may be considered a repeat infringer if Quoth GM has received more than one valid DMCA takedown notice identifying that user's content as infringing.
Quoth GM reserves the right to terminate any account for a single act of infringement if the circumstances warrant, including where the infringing content is substantial, willful, or commercial in nature.
6. What Happens After We Receive a Notice
Here is what you can expect after you submit a valid takedown notice or counter-notice.
Upon receipt of a complete and valid DMCA takedown notice, Quoth GM will: promptly remove or disable access to the identified content; notify the user whose content was removed; and inform the user of their right to submit a counter-notice.
Upon receipt of a complete and valid counter-notice, Quoth GM will: forward a copy to the original complainant; and restore the removed content within ten (10) to fourteen (14) business days unless notified of a court action.
Quoth GM is not required to adjudicate copyright disputes. Our role is to follow the procedures required by law.
7. A Note on Fair Use
Copyright law includes fair use, which permits certain uses without the owner's permission. Quoth GM cannot evaluate fair use claims on your behalf.
Nothing in this policy limits any rights users may have under the fair use doctrine (17 U.S.C. § 107). Quoth GM does not make determinations of whether particular uses constitute fair use. Users who believe their use is protected by fair use are encouraged to seek independent legal advice.
